The meeting was called to order at 5:30 PM by Gary Moore, the HOA President.
The primary purpose of the meeting was to vote on the proposed Bylaws and Covenant changes. Since there was not a quorum at the January 26, 2016 it was necessary to have a 2nd meeting. A tally of the owners present and the proxies that had been submitted revealed there were enough owners and proxies to vote on the bylaws which require a simple majority of the homeowners but there were not enough owners/proxies to vote on the covenants changes which require a 75% quorum. Toby Terrell moved, John Gensiger seconded, that the proposed bylaws be approved. This motion passed.
There was additional discussion regarding the need to change the covenants to close a loop hole regarding the insurance deductible. It has widely been known and acknowledged that unit owners are responsible for damages that occur within their units. The HOA insurance covers damages from the walls out. However, the way Section 15(c) of the covenants is worded claims for internal damage have been presented to the HOA insurer and paid. The HOA has had to pay the deductible which is $10,000. An electronic ballot will be created and sent to the members in an effort to get 75% of the homeowners to vote on the covenant changes.
