Urgent Owner Action Required

University Woods HOA

There is an active request to re-zone 3624 Tryon Rd, Raleigh NC from Residential to Commercial. This company is being represented by Attorney Isabel Worthy Mattox, Mattox Law Firm.


This property borders on University Woods (216 units) behind the Clubhouse, Buildings 3730 and 3710, and Tryon Place Townhomes (71 Units). It is the stated intention of the owner of these 9+/- acres to establish a tree services company (possibly a landscaping company), complete with an office building, 33,000 square foot garage, ample parking, a commercial nursery area, and potentially, an area for the sale of mulch and wood chips. Hours of operation are proposed 7:00am-8:00 pm, minimum 5 days a week. Activities involve the storage and use of diesel-powered 6 & 10 wheeled trucks, payloaders, possibly cranes, shredders, and mulching equipment. Other equipment types are unknown currently.


The impact on University Woods is severe: Loud equipment noise, heavy equipment traffic 14 hours per day, water runoff to our property, air, light, dust, and noise pollution. All these elements will severely disrupt the peace and quiet expected by our student and non-student population. This re-zoning action will create financial hardship and an invasion of our rights to said peace and quiet. This will affect our ability to rent to students (they will move elsewhere), and our owner-occupied units (they may sell). All of this results in lower rental opportunities and revenue, and lower sales appeal yielding lower sales pricing.


The purpose of this communications is to request that each of us write the Raleigh Planning Commission (email) at: planning.commission@raleighnc.gov expressing your objections to this re-zoning request. It is important that you copy the HOA at uwhoa.webmaster@gmail.com on your correspondence. The re-zoning of 3624 Tryon Road must not be allowed to happen. It is critical that we make the objections of all surrounding residents known to the City of Raleigh Planning Commission, and if necessary, the Raleigh City Council.
